Fighting Robo Calls and Spam Text Messages

What Can I Do?
Consumers are protected from unsolicited commercial text messages by the Telephone Consumer Protection Act (“TCPA”), enacted in 1991. For example, the TCPA prohibits unsolicited text messages to personal cell phones unless they are sent for emergency purposes or the recipient has given express consent to receive such messages. The TCPA provides for statutory damages of between $500 and $1,500 for each individual unsolicited commercial text message.
Preventing Spam Before it Starts
One of the more proactive ways of fighting Robo Calls and Spam Text Messages is to guard your phone number and pay attention to agreements you sign with your number. This means that whenever you fill out forms online, make sure to read the terms and conditions of submitting your information. Unless explicitly stated, companies should not use your cell phone number to text or make pre-recorded calls in order to promote their products.
