Bourne-Miller v. BMW of North America, LLC

We served as class counsel on behalf of current and former owners of certain MINI vehicles allegedly suffering from a continuously variable transmission (CVT) defect that causes them to prematurely break down. In doing so, we negotiated a nationwide class settlement that provides for, among other things, reimbursement for the costs of repairing or replacing the CVT, a 3-year/50,000-mile parts warranty for any CVT repaired or replaced at a MINI Dealership or BMW Center, and reimbursement for the costs of selling a vehicle for $4,000 or less as a result of an ur-repaired CVT-related problem.

Keegan v. American Honda Motor Co, Inc.

We served as class counsel on behalf of current and former owners of certain Honda Civic vehicles allegedly experiencing a suspension issue which may result in uneven or premature tire wear. In doing so, we achieved multi-state class certification and negotiated a nationwide settlement that provides for free replacement of the vehicles’ control arms, reimbursement for previous control arm replacements, and reimbursement for tires replaced due to premature tire wear.

Kennedy-Lebar v. Volkswagen Group of America, Inc.

We served as class counsel on behalf of current and former owners of certain Audi and Volkswagen vehicles allegedly equipped with defective headlights. In doing so, we negotiated a nationwide class settlement that provides for, among other things, full reimbursement for the costs of repairing or replacing the headlights and a 5-year/50,000-mile warranty extension for headlight parts.

Sadowska v. Volkswagen Group of America, Inc.

We served as lead class counsel on behalf of current and former owners of certain Audi vehicles allegedly suffering from a transmission defect making them susceptible to premature failure and breakdown during normal driving. In doing so, we negotiated a nationwide class settlement valued at over $40 million that provides for an automatic extension of the warranty from 4 years/50,000 miles to 10 years/100,000 miles for transmission parts, full reimbursement for the costs of transmission repair and replacement, and reimbursement for selling the vehicles at a loss as a result of the alleged defect.

In re Mini Windshield Actions (Ehrlich v. BMW)

We served as class counsel on behalf of current and former owners of certain MINI vehicles in a national class action lawsuit against BMW, which alleged that certain MINI vehicles suffer from a windshield stress defect, and that BMW was aware of the alleged defect but failed to notify consumers or pay for windshield repairs under warranty. The lawsuit also alleged that BMW engaged in consumer fraud and implemented a secret warranty program. We negotiated a nationwide settlement that provided for 5-year/55,000-mile extended coverage for the windshield stress defect and reimbursement for windshield repairs.

Marsikian v. Mercedes-Benz USA, LLC

We represented current and former owners of certain Mercedes-Benz vehicles allegedly suffering from a water leak defect. In doing so, we negotiated a nationwide settlement that provides for full reimbursement for water intrusion repairs, as well as up to $150 in rental and towing expenses per class member; the implementation of a national maintenance program encompassing free inspection and clearing of the reed valves of the vehicles to prevent further water intrusion; free repair of any future water intrusion damage, including the installation of a secondary drain valve at no cost to the consumer, for up to 18 months after the effective date of the settlement or up to 100,000 miles on the odometer (whichever is sooner); and vouchers for those class members who cannot afford to repair the water intrusion damage to their vehicles.

Tahmasi v. 3 Day Suit Broker, Inc.

We served as class counsel against 3 Day Suit Broker, Inc. on behalf of its hourly employees in California for violations of California’s wage and hour laws. In doing so, we negotiated a class settlement that provides for an average payment of approximately $1,515 per class member.
